Terms of Service

1. Scope

These Terms of Service apply to all orders placed by consumers and businesses in the online shop SarcasmArt at shop.sarcasmart.com, including orders placed via websites of our brands that use this shop's checkout (for example cozymadness.com, a brand of Sarcasm Art UG).

The shop is operated by Sarcasm Art UG (haftungsbeschränkt), Liethberg 15, 24576 Bad Bramstedt, Germany, registered at Amtsgericht Kiel under HRB 29850 KI, represented by its managing director Daniel Thewes. Email: support@sarcasmart.com ("we", "us").

2. Conclusion of contract

The presentation of products in the shop does not constitute a binding offer but an invitation to order. By clicking the order button at checkout you submit a binding offer to purchase the goods in your cart. We confirm receipt of your order by email. The contract is concluded when we accept your order, at the latest when we ship the goods or, for digital products, when we make the download available to you. The contract language is English.

3. Prices and payment

All prices are shown in the currency selected in the shop. Taxes and shipping costs are shown at checkout. Payment is made using the payment methods offered at checkout. Payment is due when the order is placed.

4. Production and delivery

All items are produced to order by our print-on-demand partners. Production and delivery times are described in our Shipping Policy. If an item is unavailable, we will inform you without delay and refund any payment already made.

4a. Digital products

Digital products (for example PDF coloring books) are delivered as a download immediately after payment via the order confirmation email and the order status page. No physical item is shipped. You receive a simple, non-transferable right to use the files for private, non-commercial purposes; printing for your own personal use is permitted.

By placing an order for digital products, you expressly agree that we begin performing the contract before the end of the withdrawal period, and you acknowledge that your right of withdrawal expires once the download has been made available to you (see our Refund Policy). We confirm this in the order confirmation email.

5. Right of withdrawal and returns

Consumers in the EU and the UK have a statutory right of withdrawal. Details, our voluntary return conditions and a model withdrawal form are set out in our Refund Policy. For digital products, see also section 4a.

6. Retention of title

The goods remain our property until full payment has been made.

7. Warranty

Statutory warranty rights apply. Minor variations in color or print placement compared to product images are typical for print-on-demand products and do not constitute a defect. Please report damaged or defective items to support@sarcasmart.com.

8. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Liability under product liability laws remains unaffected.

9. Designs and intellectual property

All designs, slogans and images are the intellectual property of Sarcasm Art UG (haftungsbeschränkt) unless stated otherwise and may not be reproduced without our permission.

10. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Governing law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
